Patenting and Marketing


You have to be very careful when you market an item, about what names you put on the item. For example, in sports, we have, several clients have had a problem with marketing because they’ll put on University of Miami or whatever it is. And in fact, most of these schools will actually license you. If you want to use it, you can use it, for a fee, but you have to do it that way, you can’t just put the name on yourself.

It’s a little more murky when you say that this part is for a particular car and the problem there is that the consumer may assume that it is a genuine part from the manufacturer. And if it’s defective, then of course it affects the reputation of the manufacturer unfairly because it never came from them.
